User's agreement & rules of conduct for the "DVBViewer discussion board"

Use of and participation in the DVBViewer Pro discussion board/forums at

is contingent upon your ac­ceptance of the following terms and rules. By participating in the community, you acknow­ledge your acceptance of these terms.
For purposes of this agreement, "participant" refers to you. "cm&v Hackbart" refers to "Con­sulting - Marketing & Verkaufswerbung Hackbart".

General Terms

1. Scope

The forums on the discussion board are for discussing DVBViewer and associated topics and apply to all services offered by cm&v Hackbart.

2. Participant's responsibility & Third-party rights

The participant is responsible for the content of any information he or she posts to the discus­sion board. The information posted to the forums does not necessarily reflect the views of cm&v Hackbart and in no event shall cm&v Hackbart assume or have any responsi­bility or lia­bility for any information posted to the discussion board or for any claims, damages or loss­es resulting from the use and/or appearance of such information on the discussion board.
It is not permitted to infringe third-party rights when linking to other web-sites. Linking to web-sites with illegal or offensive content is not allowed. The possibility of linking to third-party web-sites does not imply any endorsement or approval by cm&v Hackbart. cm&v Hackbart is not responsible for content of third-party web-sites.

In connection with the participant's use of the discussion board, the participant shall abide by all applicable federal, provincial or local laws, including those pertaining to such areas as li­bel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement.

cm&v Hackbart does not have any obligation to, and does not in the normal course, monitor or control all information that is or becomes available on the discussion board.

cm&v Hack­bart reserves the right to review any information or contribution that is or becomes available on the forums and reserves the right to refuse to post or to edit or remove, in whole or in part, any information that is, in cm&v Hackbart's sole discretion, unacceptable, undesira­ble or in violation of these rules. We reserve the right to contact your ISP regarding any inap­propriate activities by you on the discussion board.
If you hold the opinion a participant infringed your rights you are under the obligation to con­tact cm&v Hackbart in the first place via the address provided on http://www.DVBViewer.com or http://www.DVBViewer.tv or to approach one of the administrators or global moderators via the discussion board (the corresponding persons are indicated by red and green colours). The contribution in dispute will be removed immediately.

3. Assignment of copyright / Licencing

By submitting information to cm&v Hackbart, you grant cm&v Hackbart a perpetual, royalty-free, worldwide license to sublicense, use, transmit, copy, edit, excerpt and display such in­formation in any and all media now known or hereinafter devised and represent that you have all necessary rights in such posting.

4. Indemnity against liability

The discussion board is provided on an “as is” basis without warranties of any kind, either ex­press or implied, including without limitation or fitness for a particular purpose. cm&v Hack­bart does not warrant that any information is complete or accurate, that the discussion board will be uninterrupted or error free or that any information is free of rogue programming.

Under no circumstances, including negligence, shall cm&v Hackbart be liable for any direct, indirect, incidental, special, punitive or consequential damages that may result from the use or inability to use the discussion board, including without limitation use of or reliance on infor­mation available on the discussion board, interruptions, errors, defects, mistakes, omissions, deletions of files, delays in operation, or transmission, non-delivery of information, disclosure of communications, or any other failure of performance.

You hereby release and waive any and all claims and/or liability against cm&v Hackbart aris­ing from or in connection with your use of the discussion board. You also agree to defend, in­demnify and hold harmless, cm&v Hackbart, from and against, any and all claims or liability, including costs and attorney fees, arising from or in connection with your use of the discus­sion board or failure to abide by applicable law.

cm&v Hackbart shall have the right to immediately terminate any participant's use of the dis­cussion board if cm&v Hackbart determines in its sole discretion that the participant has vio­lated the rules of conduct set forth herein or otherwise breached this agreement, or has en­gaged in conduct which cm&v Hackbart determines in its sole discretion to be unacceptable.


5. Protection of Your Password; Unauthorized Access

Users are solely responsible for protecting their accounts from access by others. You are strongly encouraged to select a hard-to-guess password and not re-use that password on any other sites where it may be read by the owners or administrators of that site.
Accessing or attempting to access any user account not belonging to you without permission is prohibit­ed. Accessing another user's account in this manner is grounds for a permanent ban of the participant's account from the site.


6. Registration Requirements

In order to post messages on our message boards, view boards with level restrictions, and use other advanced services, you must register using a valid e-mail address and follow all re­quired registration confirmation procedures. No posting privileges will be granted until the ac­count is fully activated.



I - General rules of conduct

§ 1

Read up before asking! There are multiple guides, a FAQ and diversified sub-forums with a lot of information. Thus you are encouraged to use the search function before posting. Chance­s are your question has already been answered.

§ 2

Respect the netiquette: Look around and get to know the forum before you post. Keep the fo­cus when posting: Questions or posts in the wrong forum will either be moved or be deleted in case of § 4.
Please keep your comments consistent with the subject and purpose of the conversation thread. No irrelevant or off-topic posts. Posts which are not relevant to the fo­rum topic may be deleted at the moderator's discretion. Check for open topics. Before pos­ting a new topic, please check to see if there is already a topic open on the subject.

§ 3

Do not disrespect the moderating team. Do not make inappropriate or offensive posts - espe­cially including threats, harrassment, swearing, prejudice, slander or deliberate insults/na­me-calling, or other negative remarks about cm&v Hackbart, the moderators and administra­tors or your fellow participants. Be respectful at all times.

§ 4

Do not post the same topic in multiple forums. If you are unsure of which forum a thread should go under, just state that in your post, and a moderator will move the thread to the cor­rect forum. Multiple posts are unnecessary and will be deleted. It is also not allowed to post the same question multiple times in multiple threads in the same forum.

§ 5

Use a title that describes the content of your post. Do not use intentionally hard-to-read topic titles or posts (for example ALL CAPS, AlTeRnAtE cApS, no spaces, no or excessive punctua­tion).

§ 6

Do not send PM (PM stands for "private message," an e-mail-like system that allows a parti­cipants to send messages to each other through the forum) or e-mails to moderators or ad­ministrators, these will be ignored except for infringements of your rights.

§ 7

You may post images (for example a screen shot) for better illustration of a problem. Unless otherwise stated, if you post an image in the forums please keep the image dimensions at a maximum of 640 pixels horizontally. You should either use .jpg or .png format. Avatars and/or member photos must be of you and not infringe on third-party rights.

§ 8

Please refrain from posting meaningless threads, one word (or short) non-sense posts, or the such. Multiple or repeated posting in order to increase your post count is not allowed.

§ 9

If no one responds to your question or request, just post a reply to the same message thread again to bring the message to the top of the list so other members may notice it. But please wait a reasonable amount of time before bumping posts. For specific troubleshooting issues, use 24 hours as a guideline.



II - Inappropriate Behavior

§ 10

Rudeness, insulting posts, personal attacks or purposeless inflammatory posts will not be tol­erated. Respect other participants of the community and do not belittle, make fun off, or insult other participants or non-participants.
The participant may not transmit or encourage others to transmit material or links to material considered patently offensive in nature. This includes, but is not limited to using vulgar, pro­fane, or sexually explicit language, using race, religion, sexual orientation, culture, ethnicity, handicap, nationality, or gender as a means of insult, using threatening, harassing, defamato­ry, hate-speech, or libel and/or posting, requesting, or otherwise sharing material considered pornographic, obscene, graphic, or hate speech.

 


§ 11

Refrain from using the DVBViewer board for the purpose of 'spam' or excessive advertise­ments. This includes forum posts, private messages, or e-mails to other board members. Ad­vertising or spam is defined as posting a link for the purpose of selling, soliciting or promoting by someone that has ownership or other "vested interest" to the web-site involved, including efforts to promote other online forums or web-sites by web-site owners.

 


§ 12

Do not discuss topics concerning "warez", "crackz" or "P2P-download" of copyrighted materi­al. This includes especially illegal copies of copyrighted software, methods of circumventing copyright protection and illegal copies of any type of media.


§ 13

Do not ask for or discuss plugins for descrambling/decrypting pay-tv or key-codes.
Although the DVBViewer Pro provides full pay-tv functionality it must only be used in combi­nation with a valid subscription of a pay-tv provider, a tv-card/box featuring a "conditional access module" (CAM)and/or the corresponding "common inter­face" (CI) with a smart-card. This applies re­gardless whether software-descrambling is allowed in your country or not.


§ 14

Links must be appropriate and abide by the aforementioned rules. Only links to personal home pages are allowed in signatures and member profiles.

The possibility of linking to third-party web-sites does not imply any endorsement or approval by cm&v Hackbart. cm&v Hackbart is not responsible for content of third-party web-sites. You must abide by all applicable federal, provincial or local laws without exception.

 


§ 15

Impersonating other participants by creating and/or using a user account with a name clearly intended to impersonate, mock, or antagonize another participant, especially moderators or administrators, or otherwise falsely claiming to be another member is strictly prohibited.
The use of multiple forum accounts is not allowed. Please register and use only one user­name for the board. Posting under multiple user accounts will result in administrative actions as listed below.
Furthermore cm&v Hackbart can and do track all accounts used on the same computer and considers them one account for the purpose of monitoring violations of these rules of con­duct.

§ 16

You are to refrain from posts of an overtly political or religious nature or posts promoting ad­vocacy of particular personal, medical, legal, religious, political, or non-profit causes. Debati­ng controversial subjects must be taken elsewhere.
III - Administrative Actions / Sanctions

§ 17

To infringe the provisions of the §§ 1-9 will result in either a private or public message from an administrator or moderator pointing out the forum rules, in addition to the editing or dele­tion of the post. All offences are recorded in an internal counter. Six offences will lead to ban­ishment or deletion of the participant's forum account.

§ 18

To contravene against §§ 10, 12, 13, 14 will result in a temporary suspension of the partici­pant's forum account under the discretion of the moderating team. In case of a serious of­fence the participant's forum account may be deleted. Re-registering is not allowed.

§ 19

Infringing the provisions concerning "spam", § 11, will result in immediate banishment or de­letion of the participant's forum account. Re-registering is not allowed.

§ 20

The creation of multiple forum accounts will result in deletion of the additional accounts. The decision to delete all the participant's forum accounts it is under the sole discretion of the mode­rating team.


IV. Conclusion

cm&v Hackbart logs the participant's IP address for every action. In case of infringing third-party rights cm&v Hackbart will surrender these information in a preliminary investiga­tion.
